Terms of Service

1. Acceptance of Terms

By accessing or using PocketCDN's content delivery network services, website, dashboard, and any associated applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services. These Terms constitute a legally binding agreement between you and PocketCDN Inc.

2. Eligibility

You must be at least 18 years of age to use our Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account and Access

Access to the Services requires a valid access code issued to your account. You are responsible for:

  • Maintaining the confidentiality of your access credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that your account information is accurate and up to date

We reserve the right to suspend or terminate your account at our sole discretion if we detect any unauthorized use, sharing of credentials, or violation of these Terms.

4. Device Limitations

Your account may be accessed from a maximum of three (3) unique devices within any rolling seven-day period. Device identity is determined through cryptographic fingerprinting of browser and system attributes. Attempts to circumvent device limitations may result in temporary or permanent suspension of your account.

5. Acceptable Use

You agree not to:

  • Share, redistribute, sublicense, or publicly distribute any content obtained through the Services
  • Attempt to circumvent, disable, or interfere with any security features of the Services
  • Use automated scripts, bots, or scrapers to access or download content
  • Reverse engineer, decompile, or disassemble any aspect of the Services
  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
  • Share your access credentials with any third party
  • Attempt to access content or features for which you do not have authorized access

6. Intellectual Property

All content delivered through the Services, including but not limited to software, images, videos, audio, text, and interactive media, is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the content solely for personal, non-commercial purposes in accordance with your subscription tier.

7. Download Restrictions

Downloads are rate-limited to a maximum of five (5) downloads per file per 24-hour period. Each download is authenticated through a one-time cryptographic token that expires after one hour. Download URLs are time-limited and cannot be transferred or shared. We log all download activity for security and auditing purposes.

8. Subscription and Billing

Access to the Services requires an active subscription managed through our authorized payment partners. Your subscription tier determines the content and features available to you. Subscription fees, billing cycles, and cancellation policies are governed by the terms of your agreement with the applicable payment partner. We reserve the right to modify subscription tiers and available content at any time.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POCKETCDN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Services or via email. Your continued use of the Services following the posting of changes constitutes your acceptance of such changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
